Supreme Court Urges Government to Reconsider Sonam Wangchuks Detention

New Delhi, February 4: The Supreme Court has urged the central government to reconsider the detention of social activist Sonam Wangchuk under the National Security Act (NSA). This request comes in light of concerns regarding his health condition.

During the hearing of a petition filed by Wangchuk’s wife, Geetanjali J. Angmo, a bench comprising Justice Arvind Kumar and Justice P.B. Varale noted that the detention order was issued on September 26, 2025, making it nearly five months old. The court remarked, “The health of a person in custody is certainly not good. Previous reports indicate that his health condition is concerning. There are also age-related factors to consider. Can the government reconsider this?”

During the proceedings, Additional Solicitor General (ASG) K.M. Natarajan represented the central government, describing the NSA as a special law intended for preventive detention rather than punitive measures. He stated that the purpose is to maintain public order and protect state security, emphasizing that it is entirely at the discretion of the authorities. The magistrate must have issued the order based on evidence.

The ASG further explained that the advisory board had visited Jodhpur, where it interacted with Wangchuk and took his representation. After reviewing all aspects, the board submitted a report. He added that even if the board’s opinion is negative, the government retains the power to revoke the NSA.

The court questioned the ASG’s discretion, asserting that it must operate within the bounds of the law. Simply stating, “I feel there is a potential threat,” is insufficient grounds for detention. The court clarified that this appeal is not against the detention order under Article 32, but rather an examination of the basis and material related to national security.

In her petition, Geetanjali described the detention as arbitrary and a violation of fundamental rights. The government defended the detention, but the court called for a reconsideration based on health concerns.

It is noteworthy that Sonam Wangchuk was detained under the NSA following violent protests in Leh on September 26, 2025.
