
New Delhi, February 4: Bollywood actor Vivek Oberoi has taken legal action to protect his personality rights. He has approached the Delhi High Court regarding the unauthorized use of his image and identity. The petition was filed by his lawyer, Sana Rais Khan.
In his case, Oberoi informed the court that elements related to his name, image, voice, and identity are being used on various digital platforms and websites without his permission. This usage has not only been for commercial gain but has also harmed his public image.
Oberoi asserts that as a public figure, he holds the primary legal right to his identity, and no entity or individual can use it without his consent.
The petition submitted to the Delhi High Court highlights that in today’s era, artificial intelligence, deepfake technology, and digital advertising have made it easy to misrepresent a celebrity’s image. If not addressed promptly, this could lead to significant financial losses as well as serious social and mental repercussions.
Oberoi has requested the court to safeguard his personality rights and to impose a ban on any unauthorized use in the future.
He clarified that his petition is not against creative expression or journalistic freedom. His aim is simply to ensure that his identity is used only with his explicit consent. It is essential to obtain his permission before using his image in advertisements, promotions, digital content, or any other commercial activities.
Sana Rais Khan, Oberoi’s lawyer, argued before the court that personality rights are linked to an individual’s dignity and privacy under Indian law. Exploiting a celebrity’s popularity for profit is legally wrong, and strict measures are necessary to prevent this. Without clear guidelines from the court, this issue could escalate in the future.
Notably, in recent years, several Indian artists and public figures have sought legal recourse to protect their personality rights. The growing influence of digital platforms has made this issue increasingly critical.
